POSH Compliance – Inspection Readiness Advisory

The labour authorities have intensified monitoring of organisations’ compliance with the Prevention of Sexual Harassment Act. Inspections may be conducted to verify adherence.

To ensure readiness, companies are advised to maintain the following at all times:

Mandatory Workplace Displays

  • Updated Internal Committee (IC) list displayed prominently.
  • POSH policy is posted at visible locations.
  • POSH Act extract displayed at the site.

Records & Documentation

  • Copies of all required returns are properly maintained.
  • Details of POSH cases (if any) and actions taken are documented.
  • Reconstitution of IC Committee completed and filed (where applicable).

Inspection Preparedness

  • Records should be readily accessible to demonstrate compliance during inspections.
  • Maintain audit trails and ensure annual reports are filed with the District Officer.
  • Keep training records of IC members and awareness sessions for employees.

Recent developments, including the TCS Nashik matter, highlight that POSH compliance falls under the state government’s jurisdiction, with the Centre monitoring enforcement. This underscores the importance of being inspection-ready at all times.
