Haryana S&E Act – Exemption under section 9 & 10

The notification, issued by the Labour Department of the Haryana Government on March 30, 2026, provides an exemption for shops and commercial establishments regarding their operational hours and closing days.

The primary purpose of this notification is to exempt registered establishments from the following two restrictions:

Section 10 (Close Day): Establishments are no longer required to remain closed on a specific day of the week.

Section 9 (Opening and Closing Hours): Establishments are no longer strictly bound by state-mandated opening and closing times.

Companies must adhere to below labour welfare conditions:

  • Establishments wishing to employ women during night shifts (08:00 PM to 06:00 AM) must apply for a specific exemption.
  • This is also handled in auto-mode through self-certification, subject to the conditions laid out in the notification dated October 13, 2025.
  • Weekly/Daily Limits: Employees cannot work more than 48 hours in a week or 10 hours in a single day.
  • Total Spread-over: The total period of work, including rest intervals, must not exceed 12 hours in a day.
  • Rest Intervals: No employee can work for more than 6 hours without a rest interval of at least half an hour.
  • Overtime Pay: Any overtime work must be compensated at twice the normal rate of wages.
  • Visibility: A copy of this notification must be prominently displayed at the employee entrance and exit of the establishment.
