Please find below translation of Government of Gujarat circular for Election being held on 21.02.2021 and 28.02.2021, also Notification copy attached for your reference.
As per State Election Commission Sachivalaya Gandhinagar letter number – 110(1)—012021-k dated – 23.01.2021 with this notification for 6 Municipal Corporations (Ahmedabad, Vadodara, Surat, Rajkot, Jamnagar & Bhavnagar) and Junagadh Mahanagar Palika’s two seat sub-election for voting on 21.02.2021 Sunday and 81 Nagarpalika, 31 District Panchayat, 231 Talula Panchayat and other Swaraj election vacant seats election being held On 28.02.2021 on Sunday.
And to the shops and Establishments where Negotiable Instrument Act 1881 is not applicable and as per Provision under Clause 135B of The representation of people Act 1951 and amendment of 1996 it is ordered to give leave with wages to cast the vote.
With this, for the elections being held on 21.02.2021 and 28.02.2021 for Mahanagar Palika/Nagarpalika/Jilla Panchayat/Taluka Panchayat general election and other Swaraj eletions under Shots & Establishments (Regulation Of Employment and Conditions of Service) Act 2019,
- Leave with wages to be given to all persons who is eligible and working with Shops and Establishment
- If as per above point 1, there should be not deduction or change in wages and if the person is employer on condition that he/she will not get wages for such work and if he has not been extended leave, then also he/she should get the wage as applicable.
- If any employer does not follow the above point 1 and point 2, he will be penalised under The representation of people Act clause 1 for Rs 500
- This clause will not be applicable to any person who is working at a place where due to his absence it can get dangerous or heavy loss can happen.
- As per Provision under Clause 135B of The representation of people Act 1951 this is also applicable to daily labours or casual labours.
