The Ministry of Labour & Employment has released a Compliance Handbook for Employers under the Four Labour Codes.
It is important to clarify its scope before implementation planning.
Applicability of the Handbook
The Handbook has been issued for establishments where the Central Government is the “appropriate Government.”
This typically includes:
- Central Public Sector Undertakings
- Railways, mines, oilfields
- Major ports
- Banking and insurance companies
- Telecom and certain nationally regulated sectors
- Establishments under Central authority or control
Position for State-Sphere Establishments
The Four Labour Codes are Central legislations and will apply across India.
However, implementation is split between:
- Central Government Rules (for Central-sphere establishments), and
- State Government Rules (for State-sphere establishments).
For establishments where the State Government is the appropriate Government (which includes most private sector companies), compliance requirements will be governed by the respective State Rules notified under the Labour Codes.
Therefore:
- The Handbook can be used as a conceptual and structural reference.
- It should not be treated as a definitive compliance guide for State-sphere establishments.
- States may issue their own rulebooks, forms, portals, and possibly employer guidance, but those are not published yet in a Centralised handbook form.
Procedural aspects (forms, filing mechanism, authorities, thresholds, portal registration) may vary based on State notifications.
